Terms of Service
These Terms of Service ("Terms") govern your use of the client galleries and online store operated by
Duv Shack Media LLC ("Duv Shack Media," "we," "us") and hosted on the Pixieset platform (the
"Galleries"). By viewing a Gallery, downloading images, or placing an order, you agree to these
Terms. If you do not agree, do not use the Galleries or place an order.
1. Who may use the Galleries
Galleries are provided for clients of Duv Shack Media and the families of photographed athletes.
Many Galleries are password-protected. You are responsible for keeping your gallery password and
download PIN confidential. Passwords and download links are issued for your household's use and
may not be published or shared publicly.
2. Copyright and ownership
All photographs, images, and other content in the Galleries are the copyrighted property of Duv
Shack Media LLC and are protected by U.S. copyright law. Purchasing a digital file or print product
does not transfer copyright or ownership of the image to you. No rights are granted except those
expressly stated in Section 3.
3. License for purchased digital images
When you purchase a digital image or digital gallery download, Duv Shack Media grants you a
non-exclusive, non-transferable, personal-use license to:
• Download, store, and back up the purchased files for personal use;
• Print the purchased images for personal, non-commercial purposes (for example, prints for your
home or gifts for family);
• Post the purchased images on your personal social media accounts.
You may not:
• Sell, sublicense, or commercially exploit the images in any way, including advertising, business
promotion, sponsorships, or resale;
• Claim the images as your own work, or enter them into contests or publications without our written
permission;
• Edit, filter, or alter the images in a way that removes or obscures any watermark where present, or
use the images to train artificial-intelligence or machine-learning models;
• Share download links, gallery passwords, or purchased files with other families or third parties so
they can obtain the images without purchasing them.
Images delivered without charge (for example, previews) are licensed only for personal viewing and
sharing on personal social media, not for printing, unless expressly stated otherwise.
4. Print and physical products
Print and physical products (including banners, big head cutouts, and photo buttons) are produced to
order. Products are fulfilled by Duv Shack Media and its production partners. Because each product
is custom-made from your selected image:
• Production and delivery times are estimates, not guarantees. Typical turnaround is 7–14 business
days from order unless otherwise stated at checkout;
• Minor color and cropping variations between screen previews and finished physical products are
normal and are not defects;
• You are responsible for confirming the athlete's name, image selection, and spelling at checkout.
Orders with customer-provided errors (such as a misspelled name submitted at checkout) are not
eligible for free replacement.
5. Orders, pricing, and payment
Prices are shown in U.S. dollars at checkout. Sales tax is collected on physical products as required
by Florida law; digital downloads are not taxed in Florida. Payment is processed by third-party
processors (including Stripe and/or Pixieset's payment partners). We do not receive or store your full
payment card number. We reserve the right to correct pricing errors and to cancel and refund any
order affected by an error.
6. Refunds and replacements
• Digital downloads: Due to the nature of digital goods, all digital download sales are final once the
download has been delivered or accessed. If a file is corrupted or technically defective, we will
re-deliver a working copy at no charge.
• Physical products: If a physical product arrives damaged or with a production defect, contact us
within 14 days of delivery with a photo of the issue and we will, at our option, reprint or replace the
item or refund the product price.
• Wrong item: If we ship the wrong product or image, we will replace it at no charge.
Chargebacks or payment disputes filed for delivered, non-defective digital products may result in
revocation of the license in Section 3.
7. Gallery availability and archiving
Galleries remain online for a minimum of 90 days from the delivery date shown in your delivery email,
unless a different period is stated for your event. After a Gallery expires, image files are archived
offline for up to one (1) year from the session date; retrieval and re-upload of an archived Gallery may
incur a $25 archive fee. After the archive period, files may be permanently deleted. You are
responsible for downloading and backing up your purchased files promptly.
8. Photographs of minors; consent and removal
Team and event photography is performed at the request or with the permission of the organizing
team, league, school, or event host. By registering an athlete with the organizing body and/or
purchasing from a Gallery, the parent or legal guardian consents to the athlete's photograph being
taken and offered for sale in the Gallery. If you are a parent or legal guardian and want an image of
your child removed from a Gallery, contact us and we will remove it promptly.
9. Portfolio and promotional use
Duv Shack Media may use images from sessions for its portfolio, website, social media, and
marketing, unless the client or the athlete's parent/legal guardian opts out in writing (email is fine)
before or within 7 days after the session. Opt-out requests are honored for future use.
10. Prohibited conduct
You may not scrape, bulk-download, or use automated tools on the Galleries; attempt to bypass
passwords, watermarks, or purchase requirements; or use Gallery content to harass, defame, or
impersonate any person.
11. Disclaimers and limitation of liability
The Galleries and products are provided "as is." To the maximum extent permitted by law, Duv Shack
Media's total liability arising from any order or use of the Galleries is limited to the amount you paid for
the applicable order. Nothing in these Terms limits liability that cannot be limited under Florida law.
12. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Any dispute will be brought in the state or federal courts located in Brevard County, Florida.
13. Changes to these Terms
We may update these Terms from time to time. The version posted at the time of your order applies
to that order. Continued use of the Galleries after changes are posted constitutes acceptance of the
updated Terms.
