1. Agreement to Terms

By accessing or using any digital gallery, website, or service provided by Duv Shack Media LLC (“we,” “our,” or “us”), you (“Client” or “User”) agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree with these terms, you may not access or use our digital galleries or related services.

2. Gallery Access

  • Each client gallery is accessible through a unique link and/or password provided to the client.

  • Duv Shack Media LLC is not responsible for unauthorized access due to client negligence, link sharing, or password exposure.

3. Image Ownership & Copyright

All photographs and digital images within the galleries are the intellectual property of Duv Shack Media LLC and are protected under U.S. and international copyright laws.

Clients are granted a limited, non-exclusive, non-transferable license for personal use only, including:

  • Viewing and downloading images for personal enjoyment.

  • Printing or sharing images online for non-commercial purposes, with credit to Duv Shack Media LLC where applicable.

Prohibited uses include:

  • Selling, licensing, or redistributing the images.

  • Editing, filtering, or altering the images in any way without written consent.

  • Using images for commercial, advertising, or promotional materials without a separate commercial use license.

4. Image Delivery & Retention

  • Edited digital images will be delivered through a secure online gallery within 14 business days of the session.

  • Unedited or raw files are not available for release.

  • Client galleries remain active for 12 months unless otherwise stated. After that period, the gallery may be archived or permanently deleted.

It is the client’s responsibility to download and back up images before the gallery expires.

5. Payments & Refunds

  • All sessions and packages are billed per the agreed pricing at the time of booking.

  • A non-refundable retainer may be required to reserve session dates.

  • Due to the custom nature of photography, no refunds are provided once the final images have been delivered.

6. Limitation of Liability

While every effort is made to safeguard your images, Duv Shack Media LLC is not liable for:

  • Data loss due to technical failures, hosting errors, or third-party service interruptions.

  • Unauthorized access, downloads, or sharing beyond our reasonable control.

  • Indirect or consequential damages arising from the use or inability to access the gallery.

Our total liability is limited to the amount paid for the services rendered.

7. Model Release & Promotional Use

Unless otherwise agreed in writing, clients grant Duv Shack Media LLC permission to use images from sessions for portfolio, website, and promotional purposes.
Clients may opt out of this release by providing written notice prior to the session or delivery of images.

8. Modifications to Terms

Duv Shack Media LLC reserves the right to update or modify these Terms of Service at any time. Updated terms will be posted on our website with a new effective date. Continued use of the galleries after updates constitutes acceptance of the revised terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
